Think about “Now, Where, How”

As well as the “hard skills” of law and negotiation we use the “soft skills” of mediation and collaboration to facilitate progress.

Separation and divorce is a time of massive change. Research shows that to obtain the best from any change process you need to look at where you are now and to have a clear picture of the current situation. It can often be very helpful to ‘stick a peg in the ground’ which shows all of the issues that need to be dealt with. This helps to monitor the resolution of those issues over time.

There are many ways to conduct the ‘Now’ analysis. Using various tools that help to organise thoughts and shake out ideas we can help you to stretch the boundaries you have or may need to set for yourself and your family.

Once that is done the temptation that arises from carrying out a ‘Now’ analysis is to start fixing all the things that you find wrong. We say that is jumping from the ‘Now’ analysis directly to the ‘How’.

However we advise clients that a better option is to avoid this temptation and invest the time into conducting a ‘Where’ analysis. This is not short term. It requires vision and is much harder to do. Where do you want to take each of the items that your ‘Now’ analysis shows need to be sorted out?

The key is to have a good understanding of ‘where’ we are heading so that when we do get to the next stage – ‘how’ - we know what is important and what is not.

In a divorce context very often the ‘How’ involves action and the various legal processes leading to solutions. How do we get to where we want to be? This will usually involve communication with your spouse, their solicitor, mediators or the gathering of information. It marks the real start of moving things along and sets out the actions that move us from the ‘Now’ to the ‘Where’.
