Brexit and Family Law


Resolution has provided a short guidance to the international aspects of family law and how they will be affected by Brexit, this is a summary of what they have said:

“Brexit briefing January 2020  

As I’m sure you will all be aware, the UK will finally be leaving the EU on 31 January 2020 further to the European Union (Withdrawal Agreement) Act 2020.

An implementation period (previously called the transition period) will run from 1 February 2020 to 31 December 2020. During this period:

  • it is expected that negotiations on the future relationship between the UK and the EU will take place with any negotiated settlement requiring ratification by both parties before the end of the year;
     
  • the current EU instruments, including all EU family law instruments, will continue to apply; and
     
  • the UK will remain subject to the 2005 Hague Convention on Choice of Court Agreements, the 2007 Hague Convention on the International Recovery of Child Support and Other Forms of Family Maintenance, and the Lugano Convention 2007.”

After the transition period, the future depends on whether a negotiated settlement can be reached with the EU or not. Watch this space…..
